Many of you have probably seen the recent billboards dotting I-95 heralding the victories of local law firms which identify the amount that they recovered on behalf of their clients.
However, sometimes you need to read between the lines. On the field of combat or on the sports fields, determining the winner and the loser is fairly easy to accomplish. However, in the legal setting, that can be subject to interpretation. For example, when you first saw a billboard stating that a law firm obtained $370,000.00 for their client you might have thought it was an impressive result that the firm achieved. However, what if that firm had been offered $600,000.00 to settle the case before a trial and only achieved a $370,000.00 verdict after the trial. Would the results seem impressive in that context?
As lawyers, our job is to zealously and vigorously advocate our clients’ position. For personal injury cases, the only leverage we have with insurance companies that make low offers to settle a case is to take the case to trial. Our barometer of success is if the jury returns a verdict higher than the last offer by the insurance company. Accordingly, it is imperative for people injured in accidents to have trial lawyers who excel in the courtroom.
